Unlawful Possession of Airsoft Gun is a Felony in NJ

Even toy guns can get you in serious trouble in New Jersey. According to NJ law, unlawful possession of an imitation firearm, such as an Airsoft gun, can be classified as a third degree felony (N.J.S.A. 2C:39-5(b)).

A 13-year-old boy in Mays Landing is finding out all about this law the hard way. He allegedly fired an imitation firearm – an Airsoft gun – at a school bus filled with children in early May. According to an NJ.com article, police say the boy was waiting behind a tree around 4 p.m. when he suddenly jumped out and started firing the gun at the bus. Witnesses said several projectiles hit the exterior of the bus.

At the time of the incident, the bus was traveling in the area of Melvin Newton Boulevard and Annapolis Avenue. The bus was carrying grade school children. Thankfully, none of the children onboard were injured in the attack.

The boy, who remains unnamed due to his age, faces several felony charges, including fourth degree unlawful possession of a weapon and third degree possession of an imitation firearm for an unlawful purpose. If the suspect in this case is tried as an adult, he could be looking at serious penalties, including jail time.
